Deliberations on the Practice of Centralized Jurisdiction in Environmental Resource Cases in River Basins

Abstract： The centralized jurisdiction of environmental resource cases in river basins is an important innovation in China's environmental justice reform. It aims to resolve the structural contradiction between the holistic protection of river basin ecosystems and the fragmented jurisdiction based on traditional administrative divisions. By integrating adjudicative resources on the basis of river basins or ecological function zones， this mechanism has achieved notable results in optimizing the allocation of judicial resources， unifying adjudicative standards， and enhancing the level of professional specialization in adjudication. However， constrained by factors such as inadequate institutional regulations and local protectionism， the centralized jurisdiction of river basin adjudication still faces multiple dilemmas in practice. These include unclear boundaries of jurisdictional scope， vague standards for case identification and allocation， inadequate cross-regional coordination mechanisms， and a need to further strengthen professional adjudicative capacity. This paper argues that， in order to effectively enhance the overall effectiveness of judicial protection for the ecological environment， it is necessary at the river basin level to further improve the system for allocating jurisdiction over environmental resource cases in river basins， establish a refined mechanism for case identification and diversion， strengthen inter-basin judicial coordination mechanisms， and reinforce the development of specialized adjudication systems. Only by doing so can the systematic governance philosophy that “mountains， rivers， forests， farmlands， lakes， grasslands， and deserts form a community of life” be truly implemented， thereby supporting the rule-based implementation of ecological civilization construction and the green development strategy.
