Issuesand Reflections on the Filing Review Mechanism from the Perspective of Buildinga Rule-of-Law Business Environment

Abstract：Theconstructionofabusiness environment based on theruleoflawisacore project forthe modernizationofnationalgovernance，andtherecordreviewmechanism，asacorelinkintheruleoflawsupervision system，has an irreplaceable role in building abusinessenvironment based ontheruleoflaw.In the constructionofthebusinessenvironment undertheruleoflawastheperspectiveofanalyzingthecurrent filingreview mechanism，found that the existenceof the systemand practice of the doubledilemma.China‘s recordreviewmechanism has formedabasiclegislativeframework，buttherearestilllocal normativedocumentsand higherlawlagging behind，normativedocumentsandpolitical standardsdisconnect，rationalityof thereviewoftheabsenceofemergingareasofthereviewofthespecializationofthelackofsystemshortcom ings，practiceisalsofacingthereviewof theimplementationofthepowerandqualityof theweakness of the correctivemechanismoftheauthorityof thelack ofreal challenges，restrictingthenorms of theadminis trativepowertomaintainmarketfairness.Thishasrestricteditscorefunctionofregulatingadministrative power and maintaining market fairness.Tothis end，this paper proposes a threefold optimization path： first，torectifyandclean upthe problematicenterprise-related regulations.second，toinnovateanddrive thefiling reviewwork.third，to strengthenthefiling review systemconstruction.Through institutional improvementand practical inovation，thefilingreview mechanismwill bepromotedtobetter servetheconstructionof a business environment basedon theiruleoflaw，andto build auniform，fair and predictable institutionalenvironmentformarketplayers.
