老旧小区加装电梯表决规则的适用与完善

Application and Improvement of Voting Rules for Elevators Installation in Old Residential Areas

-Based onthe Interpretive Theory of Article 278 of the Civil Code

Abstract：Inpromotingthinstalationofelevatorsinoldresidentialareasasakeylivelioodproject，theCilCodehasestabld the“doublemajoritrule”forvotingonmatersofcommonconcentoowners.However，teaplicationofthisclausefacesssussuchas ambigutyegardingthesopeofligiblevoters，inconsistentstandardsfordetemining“participatioinvoting”，ndnuncleario of thematerssujecttovoting.Teseproblemsleadtolowefciencyinowners’self-govemanceandeventrigerdisputes.Thereforeitis necessryfromtepersectieofiterestbalaneandfousingonteinterpreatoadalicationofArticle78oftheCilodeto systematicallyexplorepathwaysfoimprovingtevotingulsfevatoristalltionthoughnorativeaalysis.Inovaielyfraork forthe“doublemajorityrule”centeredon“substantieparticipato”isproposed：strengtheningowners’rightoifomationbyroving notificationsericemechanismsandiformationdisclosuresstems；stablishngapresumptionrulethat“participaionshllbedeeds consent"；andcarifgtoundasofteutyof teraefihbongosievatorstalaterstoacests. Thisprovidesoreoerableuleudancefsolvingadocksinvotingolevatoristalltiosostpromotepiveieactiob tween owners’ self-governance and community governance.
