On the Intellectual Property Protection and Industrial Development of Blueberriesin Yunnan Province -From the Perspective of the Regulation on the Protection of New Varieties of Plants

Abstract： Yunnan Province，asa core productionarea of China’s blueberry industry，leads the nation in both planting scale andoutput.However，insufcient intellectualproperty protection hasbecomeamajorobstaclerestricting theindustry’s movetowards highqualitydevelopment.BasedonthenewlyrevisedRegulations ontheProtectionofNew Varietiesof Plantsin 2025，theresearch systematically examines the inherent conection betwee thedevelopment status of Yunnan’s bluebery industryand intellctualpropertyprotection，dentifies existingproblemssuchaslimited independentvarietyinnovationcapacity， inadequatelawenforcementandsupervisionmechanisms，andineffective integrationofbrandswithvarietyrights，andanalyzes theadverse impactsof theseisses onindustrial inovationvitality，marketorder，and internationalizationproessBuildingon suchanalysis，theresearchfurtherproposes specificpaths including strengthening incentivesforvarietyright innovation，constructingamoreimprovedlawenforcementandsupervisionframework，and promoting in-depthintegrationofbrandstrategies withinteletual property.The aimis toestablishan intelectual property protection mechanism compatible withYunnan’s blueberyindustry，facilitating theindustry’s transformation fromascaleexpansionmodel toadevelopmentmodedriven by both“innovation and branding".
