Determining Standards for Platform Addiction in the Context of Digital Intelligence: Dilemmas,European and American Approaches,and Localized Pathways

Abstract:Platform addiction has emergedas a pressing public risk in the digital society,and its regulation hinges on the clear identification of legal facts concerning addiction.However,the determination of platform addiction standards faces triple dilemmas-factual,normative,and value-based.Algorithmic black boxes render relevant facts increasingly invisible. Overlapping regulatory norms generate conflicts in legal application,while tensions between user autonomy and public protection result in persistent value imbalances.The European Union has established a front-end governance model centered on the prevention of manipulation through consumer protection,digital services,and artificial inteligence legislation.However,this model does not provide explicit standards for the direct legal recognition of platform addiction.The United States,by contrast,adopts a multi-dimensional approach combining subjective and objectivecriteria through diversified legislation and enforcement.However,this approach remains constrained by fragmented standards,constitutional limitations,and regulatory lag.Drawing on China's practices in anti-addiction and algorithmic governance,a composite framework of "front-end identification,mid-term verification,and back-end confirmation" should be constructed.Meanwhile, improving evidentiary rules and burden-shifting mechanisms can help achieve a balance between freedomand public interests.Together with differentiated protection and the proportionality principle, these measures offer an institutional paradigm for the governance of platform addiction.
