The Legality of the EU's Artificial Intelligence Act under GATS Rules ： A Case Study of the Regulation of "Prohibited AI" Practices

Abstract：Against the backdrop of "data globalization"，artificial inteligence（AI） systems，underpinned by data，algorithms，and computing power， have garnered increasing international attention. Corresponding regulatory measures continue to influencethe conduct of international trade.It is therefore of immediate practical significance toexamine the legalityofAI regulation within the framework of international tradelaw.As the world's first comprehensive regional regulatory framework for AI，theEuropean Union's Artificial Intellgence Act（AIA） serves asa model for assessing the legalityof AI regulation under the rules of the General Agreement on Trade in Services （GATS），particularly concerning trade in services.Based onthe efective regulatory rules prohibiting artificial intelligence，this paper explores the legitimacyofAIAunder theGATS rules and studies various conflicts between the regulation of artificial inteligence services under AIA and the GATS rules，it is necessary to examine the legalityof the AIA under GATS rules，analyze the various conflicts between the AIA'sregulatory framework and GATS.Analysis suggests that while theregulations on "prohibited AI practices"may conflict with certain GATS provisions，their legal liabilitycould beexempted under specificcircumstances.The research findings willcontribute to the establishment of an effective artificial intelligence regulatorysystem in China in the future，providing a Chinese solution for global artificial intelligence governance.
