A discussion on the path selection of criminal law regulation for manipulating behaviors of sports competitions

Abstract:Through behavioral deconstructionand normative comparison,this study proposes four criteria to select regulatory paths forcriminal law,namely clarifying thebehavioral structure asa prerequisite,recognizing the independent legal value of sports competitions as the core, ensuring alignment with antecedent laws like the Sports Law as a key reference,and safeguarding the coherence of the criminal code as a baseline. Given that, this study finds that the path of independent criminalization willprecisely addresses the composite hazards of manipulation behaviors,synchronously achieving dual objectives of robust legal interest protection and systemic coordination withincriminal law,thus ofering superior institutional advantagecompared todependent indictment.Therefore,it has been recommended to adopt the "compound offense model" for establishing the crime of manipulating sports competitions,clearlydefining natural personsand legal entities ascriminal subjects,limiting liabilityto intetional mental states,and scientifically constructing quantifiable criteria for partial serious circumstances.
