林业碳汇交易的法律规范调适

Abstract：With the intensification of global climate change and the formulation of China's“dual carbon” goals，forestry carbon sink trading has atracted extensive social attention. Forestry carbon sinks boast ecological，economic and social values，and can realize the sound transformation of ecological， economic and social benefits through market-oriented means.This paper sorts out the practical dilemmas of forestry carbon sink trading in terms of legal systems，market operation，risk management and control，and judicial application，and summarizes relevant foreign experience.On this basis，it puts forward improvement suggestions from the perspective of normative adjustment： establishing a unified legal system for forestry carbon sink trading by clarifying the legal attributes of forestry carbon sink property rights and raising the hierarchical level of legal norms；standardizing the forestry carbon sink trading mechanism by promoting the diversification of property right transfer methods and unifying property right registration institutions; strengthening risk prevention and control and government supervision by establishing insurance mechanisms and dynamic supervision systems； and improving the “ forestry carbon sink + ecological judicature” mechanism by defining the scope of applicable cases，the priority of application and standardizing the subscription procedures.The research aims to provide references for the healthy and orderly development of the forestry carbon sink trading market.
