Abstract：The share of quantifed collectiveoperating property income enjoyed bymembers of rural colective economicorganizations is theesential expressionof theirequity，which differs from equityinindustrialandcommercial enterprises.The pledge of equity by members of rural colective economic organizations is one of the important methods for the circulation ofsuch equity.TheLawof the People's RepublicofChinaonRural Colective Econom一 ic Organizations does not makeclear provisionson this mater.To make up for this deficiency，the implementation regulations of theLawofthePeople's RepublicofChina onRural Collective Economic Organizations should be formulated in the future，taking intoaccount the special characteristics ofthe legal person of this organization.Thesereg一 ulations should clearlystipulate theconditions，registration rules，and implementation methods for the pledgeofequity by members of rural colective economic organizations.The pledge of equityof members of rural collctive economic organizationsshallmeet the followingconditions：fullcapacityforcivil conduct，nomalicious badcredit record，ability to repay loan principal and interest on schedule，disputes over the ownership of pledged equity.The pledged equity must be subject to static management. The colective economic organization must be notified of theequity pledge The pledged equity of a single shareholder shall not exceed 3% of the total equity of the collective economic organization.The pledge of equity by membersof rural collective economic organizations should beregistered through public notice，andregistrationisa prerequisite forits oppositionrather than its establishment.The pledgeof equityby membersofruralcolectiveeconomicorganizationscanbemainlyachieved through "negotiateddisposal，negotiated acquisition，public trading，application for storage，and other legal forms".

一、问题的提出

所谓农村集体经济组织成员股权质押，主要是指“农村集体经济组织成员以其享有的集体资产股权作为质押的客体，向银行业等金融机构提出申请，由银行业等金融机构向符合条件的农村集体经济组织及其成员发放的、在约定期限内还本付息的贷款行为”。（剩余11666字）
